a minute for an hour and a half. the drainage around here is in good working order. the fire department shut off the water and it's still off. >> we don't know what happened. usually when you hit the hydrant it breaks off but there's a piece of pipe still attached to it so it might just be old pipe that broke. >> reporter: check out the damage to the asphalt on alisio drive. it's buckled and will need to be repaired once they fix the pipes underneath. the water department is supposed to get here around 6:30 to start that process. so this roadway could be closed down. just one small intersection. you can get around it and there's no traffic at this hour so no traffic situation. this will probably be closed until noon if not after. live in green bay, anne makovec, cbs 5. >> no shower, no coffee, no

[ laughter ] more rain headed our way today, not big, we could see more scattered showers. so keep the umbrella handy. right now high-def doppler radar showing you things fairly dry across the bay area although we are seeing moisture coming up out of the south here where we are expecting the moisture to come from today. it's going to sweep up out of the south as that low is sitting down into the south bay so we're going to watch this moisture moving up across the bay area today so you might want to keep that umbrella handy. you get the idea the core of the low off the coast is spinning that moisture become in our direction. so here it comes up in our way so we're going to keep things a little bit unsettled. outside though, mostly cloudy skies right now. it is dry. temperatures in the 40s and 50s. let's check the roads with elizabeth. >> we have some areas of overnight roadwork including a good stretch of 880. it's a little farther south of

where this camera is between washington and hesperion. various northbound lanes are blocked until 6 a.m. now, once you get past san lorenzo everything is moving at the limit through oakland all the way towards the macarthur maze. let's check the south bay commute. here's a live look at san jose. 101 still moving at the limit approaching mckee. coming up a check of mass transit. back to you guys. surveillance cameras show a man trying to kidnap a 13-year- old girl in san jose. the teenager fought hard and breck free. cbs 5 reporter cate caugiran is at the san jose police department this morning with more on the investigation. >> reporter: officers here at the san jose police department are hoping this new surveillance video can help lead to the arrest of the suspect. take a look. we slowed down the video. first you see the victim who is wearing white get dragged from behind into a dark driveway. police say the 13-year-old girl

screamed and fought back. a few seconds later she broke free and ran down the street. police released this sketch of the man last friday morning on 33rd and saint james streets. officers commended the girl for putting up a fight. now, they say that the suspect wore blue dickie's work pants with brown shoes and they were stained with white paint. now, after reviewing that surveillance video, san jose police are asking anyone with information to contact them. cate caugiran, cbs 5. some angry parents in brentwood are demanding answers as to why an abusive teacher was allowed to continue working with children. dina holder was convicted of throwing and kicking a 5-year- old autistic child in 2010. after the incident was reported, the district moved her to another school. earlier this month the district settled with the family of the victim for nearly a million dollars and removed holder from

her teaching position. last night, parents asked the board why it took so long to get holder away from students. >> i don't care what's written down in a procedures manual or anything like that. i think that somebody should have tobacco a stand and said we need to get her away from kids. >> district officials say its difficult to fire tenured teachers. as part of the settlement, holder is on paid administrative leave and will resign at the end of the school year. since holder was only charged with a misdemeanor, she can still teach if another district hires her. 5:05 now. a man was hit by three cars while trying to cross an on- ramp in oakland. it happened last night on the 17th street on-ramp to westbound interstate 980. chp says two drivers left the scene but one driver is cooperating with the investigation. officers say the pedestrian may have been homeless. he was pronounced dead at the scene. some more bay area headlines now on this thursday. a car stolen in a home invasion

robbery on monday has turned up in the uvas reservoir. the toyota highlander was one of two vehicles stolen from a home in san jose's almaden valley neighborhood. police say three men forcing their way into the home of an elderly couple brandishing weapons tied up the victims, took money and stole the vehicles. the other vehicle was found abandoned in southern santa clara county. in san mateo county, they will hold a gun buy-back event this saturday at the fairgrounds on delaware street. the county will offer $100 for handguns, shotguns an rifles. turning in an assault weapon will earn you up to $200. in recent months several bay area cities have held gun buy- back programs. this is oakland's event held last month. today's the day governor brown gives his state of the state address. >> the governor will speak to the legislature in sacramento at 9:00 this morning. the governor is expected to tell his fellow democrats who control the senate and assembly that improving budget situation does not mean they can all go

on a spending spree. apple's days of double- digit growth could be over. investors are not too happy about it, either. apple shares fell by more than $50 in after-hours trading. that's after apple said growth in the current quarter is expected to be only 7%. in the latest quarter apple earned 13 billion-dollar the same as a year earlier. sales of iphones, ipads and imac computers were below expectation. >> if they come out with a new reflationary product line like the iphone and -- revolutionary product like the iphone and iphone, but considering they are making new products better in a revolutionary way i think they are doing well. >> the ceo told the company they are working on "incredible stuff" but didn't explain. stay tuned. a new ban on certain weapons in the united states is proposed on capitol hill today. california democratic senator dianne feinstein plans to

introduce a bill to ban assault weapons and high capacity ammunition clips. her bill is cosponsored by both connecticut democrats in the senate in the wake of the sandy hook school shootings in their state. it's opposed by the nra. >> newtown fundamentally changed things and the nra doesn't get it. >> we believe in our right to defend ourselves and our families with semi-automatic firearms technology! >> meanwhile, vice president joe biden goes to virginia tomorrow to hold a rally to promote gun control. a defiant message today from north korea. the country's top military body says it plans to carry out what it calls a high level nuclear test. a news reader said the test will target the united states. north korea is rejecting a u.n. security council resolution that passed two days ago. that resolution called a long- range rocket launch last month

[ indiscernible ] expanded sanctions or capitol hill there was crying and yelling as secretary of state hillary clinton testified about the terror attacks in libya last september but it was a question from a republican senator about allegedly misleading the public that really set her off. >> with all due respect, the fact is, we had four dead americans. was it because of a protest or because of guys out for a walk one night who decided they would go kill some americans? what difference at this point does it make! it is our job to figure out what happened and do everything we can to prevent it from ever happening again, senator [ banging fist on desk ] the senate and house foreign relations committee grilled her for more than five hours yesterday. clinton said she takes full responsibility and to her it's not just policy. it's personal. >> i put my arms around the mothers and fathers, the sisters and brothers, the sons and daughters and the wives left alone to raise their children. kaepernick is bursting with pride over his recent success as quarterback of the 49ers. last me at the un the alma mater of colin kaepernick is bursting with provided over his recent success as quarterback for the 49ers. last night at a basketball game at the university of nevada reno fans took part in a mass kaepernicking. they curled their right arms just like the player does after a touchdown. it could translate into a bump in recruiting. >> can you imagine? >> going to be huge. mayor ed lee is working up a very specific game plan as we count down to the big game. the mayor says his eye is on safety. the twin victories of a giants world series win and 49ers super bowl trip has san

francisco mayor ed lee enjoying the best of times but not gavin newsom who after years of work will be remembered as the mayor who lost the 49ers stadium to santa clara. >> it's bittersweet because you want the energy and pride and spirit that comes from their victory. i'm disappointed as a fifth generation san franciscan that they are going to santa clara. >> mayor lee says he is heartened by the fact that the 49ers will keep the san francisco name even after they move down to the south. he also says that on the day of the super bowl, he will make sure the city stays safe during celebration. if they win that's going to be lots of celebration. >> all over northern california not just san francisco. traffic-wise it is a thursday. how are we looking? >> looking okay. not seeing too many problems. one incident should be cleared quickly and in the meantime i want to show you the san mateo

bridge. problem free. everything looking good especially westbound 92, still 15 minutes. but you can see no delay at all as you head towards the high- rise. this is the commute direction and eastbound 92 looks good towards hayward. so this is the problem that we're potentially watching. there's a large amount of garbage in the road so a truck must have lost part of its load so northbound 101 approaching marsh road they are having to do round robins police clearing it out of the way. we are seeing slowing on the sensors, one yellow sensor approaching marsh road so slight delays through menlo park. they are clearing it. golden gate bridge headlights southbound in the commute direction towards doyle drive and you're free and clear. they just reopened more lanes in the commuter direction so overall that's moving fine. and roadwork this morning on the dumbarton bridge all that's left is the eastbound 84 roadwork as you cross the span. that's a check of your

"timesaver traffic." for more on this wet -- what are we in, a wet stretch? >> finally we have headed into a more wintry weather pattern and it continues this morning. fairly dry across most of the bay area but our high-def doppler radar picking up a few showers especially to the south. you can see it just beginning to creep up toward the bay area and that's where we are expecting, the moisture sweeping up out of the south. out the door fairly dry right now. temperatures mainly in the 50s. we have some patchy fog as well as some cloudy skies. this afternoon chance of more scattered showers temperatures in the 50s and 60s going to feel very muggy outside. this low is dragging up the moisture up out of the south so going to feel muggy chance of scattered showers. keep that umbrella handy with you. didn't look like a major rain event just more scattered showers throughout the day. you can see some of that early on beginning to make its way back not bay area then in the afternoon, maybe picking up a little bit again as we start to see a little afternoon heating and more of that sweep up mainly into the south bay. so you get the idea it looks

like things-unsettled today. showers and possible delays at sfo. chicago snow and bitter cold temperatures again high of 27. 28 and dry in new york. 79 in houston and 70 in denver today. temperatures around the bay area into the 50s and the low 60s this afternoon. so the whole pattern has changed now. more toward a wet pattern. nothing really big on the horizon although we'll keep more cloud on the way tomorrow and the weekend. cold showers coming in -- that doesn't sound good, does it -- on sunday. >> not at this hour. >> sorry about that. >> thank you. the school of rock movie apparently not farfetched. not after you meet mr. carter. he is the passion behind a music class that's making a lot of noise in los gatos. it's the raymond j fisher school where rock and roll is really cool. 7:25 in los gatos.

while most students are just leaving home, mr. carter's kids are already rocking. >> i like it more than any other class we take. >> reporter: they rock out every day. they are getting a crash course in rock and roll. the class is now in its 6th year and it's one of a kind. from the grateful dead to kiss, these kids are learning it all. >> i actually have a waiting list for next year. so that's -- i don't have to motivate them too much. they're here. >> reporter: do you see yourself as a female rocker someday? >> yes, i do. ♪ [ music ]♪ >> reporter: mike carter' horn player with a big heart teaches the class that provides the instruments. the parents kick in, too. no grades, no credit. this is all about fun. is it hard to rock and roll at

7:30 a.m.? >> no. you can rock and roll all day and night. ♪ [ music ]♪ >> reporter: once a month the rock band performs at the school and around the community. it's a big hit. the only drawback, the noise. >> oh, i was just saying we appreciate great music but i think i have relocated the fisher rock band about three times until i found the perfect room. ♪ [ music ]♪ >> reporter: so for fine-tuning tomorrow's rockers, the raymond j. fisher school is this week's -- >> "cool school"! >> that is a cool group of kids. >> they are. and you know what? there's more believe it or not. one of the parents of one of the kids is actually the former was player for prince. he sits in with the kids and the violinist from the silicon valley symphony also pitching in one of the music teachers there. >> a lot of fun. every tuesday and thursday

good morning. looking great across the golden gate bridge. rain on the lens makes it blurry but overall traffic light getting into san francisco and traffic is picking up through the dublin- pleasanton area. much more "timesaver traffic" coming up. the warriors find out today if they will have any reserves in the all-star game next month. i can think of two. one of them is steph curry who showed the best team in the league why he deserves to go. he had a team-high 31 against oklahoma city last night. the warriors coming back from down 8 in the fourth. they win their third in a row over thunder. and we stick with the warriors for the play of the day. late first half steph curry gets a steal from thunder guard russell westbrook and he is

bay. crews are rushing to restore water to a greenbrae neighborhood. cbs 5 reporter anne makovec is live where a water main break is having an impact on the commute. she intersects behind me is closed -- the intersection behind me is closed at alisio, the only traffic impact is here o alisio. the water main broke open around 2:15 a.m. and water was spewing several feet in the air at the rate of 1500 gallons a minute for about an hour and a half. the drainage around here is in good working order so no flooding to report. the fire department shut off the water and it's still off this morning for 13 homes as crews try to fix the mess. >> the water district will dig out the asphalt and fix the pipe and then put the asphalt back. >> reporter: that's going to take a few hours. check the damage to the asphalt

here on alisio drive. again, traffic has been rerouted around this particular intersection. the water department is set to be here at 6:30 this morning. for the homes without water now they will probably be that way until after noon. live in green bay, anne makovec, cbs 5. the rain was coming down in san jose. look at this. this was last night. parts of the bay area may see showers today, as well. it's warmed up quite a bit. >> lawrence, i had the windshield wipers going. >> you have to use those in the rain. >> welcome to california. [ laughter ] >> it's nice to see the rain after an extended dry period. it looks like more on the way. more showers out of the south and unsettled throughout the day. those showers into the south bay now but you can see it creeping up into the santa cruz

mountains. along 101, gilroy, hollister, morgan hill, seeing showers there. low down to the south rotating to the north in our direction so we'll keep things unsettled for today. not a real big storm system but chance of scattered showers, and like michelle you may need windshield wipers from time to time. temperatures in the 40s and 50s right now. 50s and 60s for highs, more rain on the way. too. we'll talk about that coming up. let's check the roads with elizabeth. >> we are going along with this whole rainy theme because we have raindrops i guess on our camera lens. that's why this shot looks like you're wearing those drunk glasses? so traffic is fine this morning heading into san francisco. no metering lights, no delays. no roadwork on the upper deck. on the maps, other live traffic cameras. we have a live look this morning at traffic conditions heading past candlestick.

good to go. no delays from downtown san francisco to sfo. should be 10 minutes. they wrapped up overnight roadwork including on the eastbound lanes of the dumbarton bridge. they wrapped up ahead of schedule so you're at the limit across the san mateo and the dumbartons. that's traffic. back to you guys >> thank you. right now, police are searching for the man who tried to kidnap a san jose teenager on her way to school. cameras captured the terrifying moments on tape. cbs 5 reporter cate caugiran is live from san jose where police where police are telling about the incident. >> reporter: it was caught on tape from a neighbor's video. we slowed it down. you can see right now, the victim in white is walking past the car. you see her get snatched from behind and dragged into a driveway. police say the 13-year-old girl put up a good fight and screamed. seconds later she managed to break free from the suspect and

run away. we do have a sketch of that suspect. police say this happened early friday morning on 33rd and saint james streets. turns out the girl's screams caught the attention of a nearby neighbor like manuel alvez. >> it wouldn't have been a pretty sight. >> reporter: he says he got into his car to look for the suspect but he missed him just by 60 seconds. he was wearing blue dickie work pants, brown shoes with white paint stance on the shoes. cate caugiran, cbs 5. >> thank you. some bay area headlines. two people are under arrest in connection with a fire at a vacant victorian house on harrison street in oakland. the two were rescued from the roof of the burning house just after 5:00. it took firefighters three hours to put it out. according to the owner, the vacant property is known to house squatters especially when it's raining.

a $26 million security system is coming to the new eastern span of the bay bridge including 175 video, infrared and thermal imaging cameras. the equipment will be atop the bridge and beneath it and will include a monitoring room. the system was originally expected to cost about $8 million. 5:36 now. later this morning we'll get the governor's take on how things are going here in california. jerry brown will deliver his state of the state address to the legislature. the governor is expected to tell his fellow democrats who control the senate and assembly that an improving budget situation doesn't mean they can go on a spending spree. days of double-digit growth for apple are over. apple stock tanked in a big way by more than 50 bucks in after- hours trading last night after apple said growth in the current quarter is expected to be only 7%. in the latest quarter apple earned $13 billion the same as the year earlier. sales of iphones, ipads and mac

computers were below expectations. >> if they come out with a new revolutionary product loin similar to what happened when they introduced the iphone and the ipad, but considering that they are essentially retreading existing products making them better in an evolutionary way, i think they're doing pretty well. >> apple's ceo tim cook told analysts yesterday that the company is working on what he calls some incredible stuff but he did not elaborate. we'll wait and see. the city of menlo park has given facebook the go-ahead to build a second campus near its original headquarters. the social network wants to develop a west campus where taiko electronics operated on bay front expressway there. in exchange, facebook will give the city more than a million dollars over the next 10 years. that does not include the nearly $200,000 facebook will pay in property taxes. california's senior senator wants to reinstate a ban on certain firearms across the country. today democrat dianne feinstein will introduce a bill to ban

benghazi and is asking all brits to leave that city. military women could soon be moving to the front lines. later today, defense secretary leon panetta is expected to make the official announcement removing the military's ban on women serving in combat. military chiefs must decide whether women should be excluded from any of the more demanding deadly positions such as navy seals or the delta force in the army. north korea is once again issuing warnings some of them directed at the u.s. regime -- or the regime says it's prepared to conduct a nuclear test and carry out more long range rocket launches following the united nations security council's sanctions against the country. coming up flooded and frozen. how survives of superstorm sandy are now dealing with a deep freeze. >> they asked me the same question, you know, what would you do? >> well, what was he thinking?

major warehouse fire in chicago's south side. it actually started two days ago... bringing out ity's fire crews are on the scene of a major warehouse fire on the south side of chicago that started two days ago, bringing about a third of the city's fire department out there to help fight it. firefighters firefighters had it under control but the warehouse began burning again this morning. the building is filled with old timber. investigators believe hot spots from the initial fire rekindled the flames. this is the biggest fire chicago has seen in 7 years. you can see from the video it is a big undertaking for those firefighters out there. take a look at this. temperatures were so cold in new york, overnight, the fountain at bryant park froze

over. arctic air brought temperatures down into the mid-teens. the coldest temperatures are expected later today. some victims of superstorm sandy are trying to get by with propane heat, because their utilities still haven't been restored. >> amazing. >> they're not catching a break there. >> i was talking to some friends in portland, maine last night. it's like 4 degrees there with a wind chill of minus 10. >> yeah. in some ports northern montana some of those areas, wind chills minus 50 degrees. that's very dangerous weather. coldest temperatures we have seen in years across parts of the united states. we are looking at a lot of clouds outside, looks like rain has returned finally yesterday and we could still see a few more showers outside for today. our high-def doppler radar picking up on some of that moisture. it's just beginning to sweep up out of the south again back toward the bay area so into the santa cruz mountains, san jose, gilroy, morgan hill, see some showers headed in your direction. mostly cloudy around the rest of the bay area. even some reports of patchy fog in some of the valleys. this afternoon, clouds and a

chance of showers and temperatures will stay down but it's going to be muggy, 50s and some 60s for highs. here's your system off the coastline. the low dropped to the south but not kicking eastward yet so all that moisture spiraling around and back up into the bay area and that's what could cause a few more raindrops outside so keep that umbrella handy. not going to be a washout today. we may see occasional showers from time to time. computer models picking up on that just scattered showers around the bay area. as we head through the day, maybe some of that picks up again toward the afternoon, you get a little sun and, well, before you know it you got the heating and a few more showers popping up outside and then it looks like things begin to settle down tomorrow, although there will be a lot of leftover clouds. temperatures in the 50s in the central valley showers in lake tahoe and yosemite, air mass very warm so the rain levels high today, as well. temperatures in the 50s and 60s around the bay area for today and the next couple of days we are going to dry out a bit but a chance of cold showers toward sunday. mostly cloudy to begin next week. elizabeth? >> okay. we'll take a live look right now across the carquinez bridge

where we have a traffic camera this morning showing you conditions heading towards crockett. and so far everything is moving at the limit. the drive time right now 18 minutes from the carquinez bridge to the maze in the westbound lanes of 80. all green on the traffic sensors all the way through the macarthur maze. elsewhere, the nimitz some overnight roadwork most of it now that we're approaching 6:00 is now pretty much wrapped up. there was some lanes blocked northbound 880 between washington and hesperian that's been picked up. dumbarton bridge roadwork is gone. so both directions of 84 free and clear. and you can see traffic is moving at the limit. these drove time sensors the green means speeds over 40 miles per hour. so 92, highway 84, and 237 a little farther south still all show some nice traffic conditions. here's a live look across the golden gate bridge northbound and southbound 101. problem-free incident-free between marin county and san francisco. so overall the drive to work

can't manage our money. they often use math that's just wrong and i think most glaring she accuses them of engaging in dubious sometimes deceitful practices to sell their books and other products. >> what about advisors, what should we know about them? >> we talked about this before. olin underscores that the advice business is rife with conflict. avoid commission based brokers, advisors and insurance salesmen. turn to an independent advisor who is required to put your interests first. she says we should steer clear of the free lunch or dinner seminars sponsored by investment or insurance companies. you know, you might get a good meal but she says you are going to pay for it in the end. and women, take note, according to olin, financial firms are targeting us. they say that we are easy marks. i don't think so. no. no. no. >> i don't think so either, jill. >> reporter: i don't think so. you can see my full interview with helene olin on
